New DOL Rule Increasing Prevailing Wages

This week, the Department of Labor (DOL) issued a new regulation increasing prevailing wages for H-1B, E-3, and H-1B1 nonimmigrant cases and PERM Labor Certifications.

Under this regulation, the DOL will impose higher prevailing wages, in phases, starting on July 1, 2021.

The regulation could be placed on hold by the incoming Biden Administration or be challenged in federal court.

The regulation will permit employers to continue to use alternative wage sources, instead of the DOL prevailing wage data.
