U.S. Family Visa

 

 

Your status determines which relatives (or future relatives such as a fiancé(e) or prospective adopted child) may be allowed to enter the United States and complete the immigration process.

In order to help a family member immigrate to the United States, you must be one of the following:

  • U.S. citizen
  • Permanent resident
  • Refugee admitted as a refugee within the past 2 years or asylum granted asylum within the past 2 years.

Family of U.S. Citizens

This table describes how you (a U.S. citizen) may petition for certain family members to receive either a green card, a fiancé visa or a K-3/K-4 Visa based on your relationship.

Type of Relative for Whom You May Petition Immigration Benefit
  • Spouse
  • Children (unmarried and under 21)
  • Sons and daughters (married and/or 21 or over)
  • Parents, if you are 21 or over
  • Siblings, if you are 21 or over
  • Green Card (Permanent Residence)
  • A fiancé(e) residing outside the United States and children of fiancé(e) under 21
  • Fiancé(e) Visa
  • Spouse
  • Children of spouse (unmarried and under 21)
  • K-3/K-4 Nonimmigrant Visa

Family of Green Card Holders (Permanent Residents)

As a green card holder (permanent resident), you may petition for certain family members to immigrate to the United States as permanent residents.

You May Petition For The Following Family Members:

  • Spouse (husband or wife)
  • Unmarried children under 21
  • Unmarried son or daughter of any age

Family of Refugees & Asylees

If you entered the United States as a refugee within the past 2 years or were granted asylee status within the past 2 years, you may petition for certain family members to obtain derivative refugee or asylee status.

You May Petition for the Following Family Members:

  • Spouse
  • Child (unmarried and under 21 when you first applied for asylum or refugee status)
